After all the insanity and craziness with the appeals, I refuse to let myself get excited until work actually starts. Let’s hope that is sooner than later.

Quite true, but this was very telling from the Star Tribune article:
Chris Osmundson, development director for Alatus, said that he didn't have an updated timeline for the project.
"We're very excited about the position of the appeals court," he said. "And we're moving forward immediately with the project."

Late 2018 start date mentioned now.

Alatus condo ruling prompts future buyers to call agents

The Alatus project, called 200 Central, is about 18 months behind schedule because of the legal wrangling. Alatus hopes to start construction late this year and finish in 2020, said Chris Osmundson, development director for Alatus. The construction schedule for the 105-unit Eleven, which is still going through city approvals, is set to begin later this year and end in 2020.

Good on the developer for not simply shelving this project once adversity set in. This outcome will indeed set a tone and precedent for future NIMBYs to consider before dumping their money down a hole. I hope it also spurs other developers to follow suit and continue to densify the downtown area, especially with desirably-located condo towers.

Recent communication from the 200 Central team;

200 Central Insiders,

Last week was an exciting one for this highly anticipated project! We received news that the Minnesota Court of Appeals sided with Alatus and the City of Minneapolis in the last remaining argument of the litigation, upholding a lower court’s previous ruling.

NEBL (Neighbors for East Bank Livability, the Plaintiff) still has one final opportunity to respond, which would require taking this recent decision to the Minnesota Supreme Court, but we are optimistically proceeding with our work and have re-engaged our exceptional team of architects, designers, creatives, and salespeople. If our optimism is warranted and NEBL does not take further action, we will be fully out of litigation in the first week of June. We are, however, prepared if NEBL does choose to request a Supreme Court hearing and can continue to be patient for a project we know will be well worth the wait. There is a tremendous amount of energy around this project, and we are committed to a tower that is amongst the best in the country. Minneapolis is ready, and we know you are, too!

Shocker: today NEBL submitted a Petition for Review to the MN Supreme Court.

The Supreme Court already turned them down once, and they have to have no money left.

Think of all the school lunch debt these people could've paid off or college scholarships they could've sponsored instead of waging a quixotic war against a high rise in the urban core.

Having money to waste in this fashion is just unfathomable.

Is there something behind the scenes here? This is some vindictive stuff, which makes it seem like they have a particular reason to spite Alatus, or whoever. They know they can't win, and yet they continue to throw a lot of money at it just to temporarily delay and add cost to the project.

I would guess that they are hoping that Alatus abandons the project. The Supreme Court already rejected their last filing, how are they allowed to file again? Can they just keep on re-filing as many times as they want?

Has NEBL won any of these filings other than the 100k hole in their pocket? I hope there's enough precedent set that Alatus can just keep moving forward while this eventually gets rejected by the Supreme Court.

Probably a competitor to Alatus is funding NEBL. There is no way people are this dumb.

NEBL can file on separate decisions. This time it’s the variances Alatus was granted and the last of NEBL’s chances to win. They have lost every decision at every level.

I wonder how long this round of appeals will take. I am so ready to see this thing started. It’s wonderful to see the developer staying strong on this one. With all of the appeals and drama surrounding this development, it might make one heck of a book. Wish we had some people from NEBL on this forum. I would actually like to engage with them and find out what’s really behind their Stark opposition to this project.

The last Petition for Review sent to the Supreme Court by NEBL took almost 8 weeks for the court to deny.

The district court’s proposed order is that NEBL lose its $100,000 bond money (divided equally between Alatus and the city). The decision will be official on Friday.
