there appears to have been no misconduct or impairment on the part of the driver...reports indicate the collision may have been the fault of the cyclist

1. Misconduct or impairment are a very high burden for motorists. We will likely never know if the driver was going above the speed limit, or if they were distracted by an intense conversation, or anything else. Our concept of what is negligence on the part of motorists is ridiculously limited. As the saying goes, "If you want to kill someone legally, do it with your car."

2. We don't know if there are third parties who witnessed this and contributed to reports. But if there are, they're statistically likely to self-identify first as motorists and sympathize with a motorist. But right now the motorist is able to speak freely while the cyclist can only share their story through simple hand movements in response to questions.

3. This entire concept that one of the two parties is at fault is simplistic. The entire system fails all of us, a system that allows high-speed traffic on streets such as Cleveland.

Could it be possible that this cyclist ignored a stop sign and sped into the path of an oncoming vehicle? And if that’s indeed what happened, would “the entire system” still be to blame?

PP update:
At about 11:45 a.m., a driver was northbound on Cleveland Avenue at Jefferson Avenue and noticed a bicyclist enter the intersection from the sidewalk, said Sgt. Mike Ernster, a police spokesman. The bicyclist slowed, but couldn't stop in time, according to police. Witnesses reported the vehicle had the right-of-way, Ernster said.

War on cars? I drive, bike, walk, and take the bus, and that's a ridiculous statement. I don't like how people drive and I don't like how the infrastructure is designed. It's an unsafe system, and cars and trucks are the most dangerous vehicles on it. Hell, I don't like how I drive sometimes, and I try to be very careful. Our system encourages bad driving and vilifies other modes.

Ughhhhh. I could've definitely see that being a factor. Last year when we did nerf wars, there were things that could've gotten us a big big fine or a night in jail. Such as speeding over 40-50 mph in neighborhoods to get away from people, hiding in the back of trucks and popping up to attack someone while driving, riding on top of cars, etc. It's probably something that could be banned from schools one day.
