A judge should not be deciding what height is right for the site. That job was already done multiple times.

Careful, you might find yourself agreeing with likely SCOTUS justice Gorsuch that "relying on judges and lawyers rather than elected leaders and the ballot box, as the primary means of effecting their social agenda” is a bad idea.

I've really not followed it, but I'm a bit baffled that those claims are what's left. Because I don't know how a judge can tell the city that it's violating rules that it created but can't modify/amend/create exceptions to.A judge should not be deciding what height is right for the site. That job was already done multiple times.
It would be one thing to allege there were rules that no one thought about, but when the were clearly raised and the exception approved, I don't see a judicial role there either.

I just read the Memorandum from NEBL's attorney. Just like the other complaint, he tries to throw a ton of information at the court thinking that quantity equals a valid argument. For example, they argued that the new building would block the view of the library, thinking that is somehow important, and not realizing that the one-story funeral home also blocks the view of the library. The judge threw out similar complaints just recently arguing that the city knows what it is doing with its own policies, so I don't think this will be much different.

NEBL has asked for a stay of demolition pending an appeal. They feel they still have a good chance of prevailing on appeal.
They also do not have the $3 million bond that Alatus asked the court to impose. Given that they have only raised $100 for appeal, they are asking to pay at most $1000.

BTW, the wrecking permit was issued back on March 27... so they're probably pretty good to go.

Final ruling on height has not been made. I know, it's taking a while. The city has a great argument in that they state that they can use ANY valid reason for their land use decisions. In other words, it is not really up to a court.

You are correct. In fact, no official decision has even been made about the stay of demolition, which is really a head scratcher at this point

The only crane I saw was the one doing roof work for the Winslow house. Where did you see a wrecking ball?
